Mobeyond B.V., a private limited liability company registered with the Crossroads Bank for Enterprises (“CBE”) under number 0786.996.731 and with registered offices located at Leuvensesteenweg 369, 1932 Zaventem, Belgium, (hereinafter referred to as “Mobeyond”), is a provider of SaaS-solutions for the Automotive industry.
Mobeyond is a part of the Renta Solutions Group. The Renta solutions group consists of Renta Solutions NV, CBE 0503.995.766, and its 100% subsidiary Mobeyond B.V.
Mobeyond respects the privacy of its users. This Privacy Policy explains how Mobeyond collects, uses, discloses and safeguards information of data subjects when they visit the website and /or platforms.
Please read this Privacy Policy carefully. Mobeyond aims to establish itself as a trusted partner and, for this reason, strives to respect and protect personal data. This Data Privacy Policy explains how we collect, store, use and disclose personal data when our products, services and websites are used or when clients interact with us in another capacity.

Mobeyond acts as a data controller, for all data it receives directly from data subjects through its website, platforms (excluding the personal data that is provided by its customers) and other communication channels.
As part of its activities and services, Mobeyond processes, amongst others, personal data provided by data subjects, including but not limited to, leasing companies, dealers, tyre fitters, groups of tyre fitters and, at large, of any user/ customer of the SAAS-platforms of Mobeyond. With respect to such processing activities, Mobeyond qualifies as “data processor”, the customer being the data controller. Mobeyond is responsible for the protection of the personal data of the data subjects in accordance with the processing instructions it receives from the data controller.
2. Applicable Law
Mobeyond is committed to protecting the privacy of all of its users Personal Data and providing a secure, user-controlled environment for the use of the Products in accordance with the European General Data Protection Regulation ( hereinafter “GDPR”), any applicable national laws implementing the EU Directive 95/46 on the processing of personal data or further completing the GDPR as well as the Belgian Data Protection Act of 30th of July 2018.
Mobeyond does not collect or process personal data without a legitimate basis. We never use your personal data for purposes that are incompatible with the purposes outlined in this Data Privacy Policy or an applicable data protection agreement. We only collect the personal data that are necessary for data processing, as set out in this Data Privacy Policy or data protection agreement.
The user is acknowledging that they share responsibility for maintaining privacy and security, for example by not allowing any third party to use their personal account on the platforms. Mobeyond asks all users to be responsible for safeguarding any authentication information and to immediately notify Mobeyond of any unauthorized use of their account.

This Policy applies to all sources of data collected and processed by Mobeyond in the context of its various business activities such as, but not limited to, the use of the Mobeyond platforms, queries through website and other communication channels, as well as customer support queries.

To provide our services, we occasionally need to use partners or processors for the purposes described above. We limit our sharing of any personal data to the following categories of recipients:
• With internal business departments such as sales, helpdesk, IT services, support and maintenance;
• With our service providers such as: data hosting service providers, IT providers, website providers, marketing agencies;
• With public authorities when required to do so by law ;
• In connection with a bankruptcy proceeding, to enforce our rights and protect our property.
Your personal data will not be shared directly with third parties for their own marketing purposes without prior consent.
Please note that we may also use and disclose personal data in the form of pseudonymized data. Pseudonymized data refers to personal data that has been processed in such a manner that it can no longer be attributed to a specific individual without the use of additional information. The additional information must be kept separately and subject to technical and organizational measures to ensure that the personal data is not attributed to an identified or identifiable natural person. This concept is often used to protect individuals' privacy while still allowing for the use of the data in various analyses and processes.

Mobeyond shall take appropriate administrative, technical and organizational measures against unauthorized or unlawful processing of any Personal Data or its accidental loss, destruction or damage, access, disclosure or use. Upon written request sent by registered mail, Mobeyond can provide you with a list of people of Mobeyond that may have access to your Personal Data. These people have entered into confidentiality agreements prior to having been granted access to your Personal Data. In the event of and following discovery or notification of a breach of the security of the Personal Data, or access by an unauthorized person, Mobeyond is required by law to notify the user (where applicable via the controller) if the breach is likely to affect your privacy.
Data collected is stored inside the EU. In some cases, cookie information may be processed by our contracted service providers or third party cookie providers in countries outside the EU, which do not offer an equivalent level of data protection.
In some countries, there is a significant risk that local authorities may obtain access to cookie information. We have put in place additional and appropriate security measures, to ensure that the information collected by cookies is appropriately protected.
11. Period of retention
We retain personal data for as long as necessary for the purposes described in this Privacy Policy, or according to the relevant laws in force.
We retain personal data for the duration of the data subject business relationship with Mobeyond and, if applicable, the termination thereof, or as long as required to comply with Mobeyond’s legal obligations.
Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements. Information that has been transferred to governmental bodies in the context of fines and retribution management is not under our control anymore and can therefore not be deleted by us.
In case of litigation, we may keep personal data until the litigation is fully resolved. We will then either delete or archive it according to applicable law.
12. Rights under the GDPR
You are entitled to exercise a number of rights with regard to the processing of your personal data vis-à-vis Mobeyond acting as the controller of your data, in so far as you effectively have those rights under applicable data protection legislation, such as the GDPR.
These may however be subject to a reasonable process of identification of the data subject and require some time to process the request whilst maintaining GDPR standards.
Where Mobeyond acts as the processor of your data, you should exercise your rights vis-à-vis the controller of your data, being in the applicable case your leasing company or employer (fleetmanager).
Right of access
If you are concerned or have any questions about your Personal Data, you have the right to request access to the Personal Data which we hold or process about you. We will then provide you with information about the data that are being processed and on the source of those data.
Right of rectification and right of erasure
You have the right to request free of charge to correct, erase or block any inaccuracies in your Personal Data if such Personal Data would be incomplete, inaccurate or processed unlawfully, insofar as permitted by law.
Right to not be subject to automated individual decision making
You have the right to request to not be subject of a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.
Right to object to data processing
Without prejudice to the termination provisions of the Terms of Use, you may withdraw at any time your consent to the processing of your Personal Data by notifying us in writing thereof via gdpr@rentasolutions.org upon receipt of this notification, Mobeyond shall promptly stop any processing of your Personal Data where it is acting as controller.
You may also ask us to stop using your Personal Data for direct marketing purposes.
You should add a proof of your identity to your request. Mobeyond will undertake the necessary action without undue delay and provide information on action taken (or the absence of any such action) within 30 days. You may also lodge a complaint with a supervisory authority in case of breach of the applicable privacy laws by Mobeyond.
